1. Introduction

Welcome to 5 Towns Models & Collectibles (“Company,” “we,” “our,” or “us”). By purchasing from our store, you agree to comply with these Terms & Conditions. Please read them carefully before placing an order.

2. Orders & Payments

2.1 Product Availability

  • All items are subject to availability. Limited-edition and exclusive models may sell out quickly.
  • We reserve the right to cancel or limit orders at our discretion.

2.2 Pricing & Payment

  • Prices are listed in USD and are subject to change without notice.
  • Full payment is required at the time of purchase. We accept major credit cards, PayPal, and other secure payment methods.
  • Sales tax may be applied where required by law.

3. Shipping & Delivery

3.1 Processing & Shipping

  • Orders typically ship within 1-3 business days unless otherwise stated.
  • We ship domestically and internationally using trusted carriers. Shipping rates are calculated at checkout.  For International orders, Custom fees may not be included at checkout.

3.2 Lost or Delayed Shipments

  • Once an order has shipped, 5 Towns Models & Collectibles is not responsible for delays, lost packages, or damage caused by the shipping carrier.
  • Any shipping-related claims must be filed directly with the shipping carrier.

4. Refund & Cancellation Policy

  • No Refund Policy: All sales are final. We do not offer refunds to prevent excessive returns. However, you may contact us to request a refund. Under certain circumstances, we will accept.
  • Cancellations: If your order has not yet shipped, you may cancel it. However, a 20% cancellation fee may apply to cover processing costs.
  • Pre-Orders & Limited Editions: Pre-orders, On Sale and exclusive items are non-refundable and non-cancelable once placed.

4.1 SQ Wings Pre-Order Terms & Conditions

     By placing a pre-order for any SQ Wings product, you agree to the following terms and conditions:

    1. Pre-Order Status & Availability

      • Pre-order items are not currently in stock and may not have a guaranteed Estimated Time of Arrival (ETA) to our warehouse.

      • Arrival dates, if provided, are subject to change without notice due to manufacturing or shipping delays beyond our control.

    2. Order Priority

      • All pre-orders are processed and fulfilled in the order they are received. Customers with pre-orders will receive priority allocation once the item arrives in stock.

    3. Payment

      • Pre-orders must be paid in full at the time of placing the order unless otherwise stated.

      • Your payment secures your place in line for the product but does not guarantee a specific delivery date.

    4. Cancellations & Refunds

      • Pre-orders can be canceled by the customer for a full refund at any time prior to the product being marked as “in stock.”

      • Once the item is in stock and your order is processed for shipment, it is subject to our standard return policy.

    5. Inventory Limits

      • Inventory for pre-orders is limited. In the rare event we are unable to fulfill your pre-order due to manufacturer or distributor shortages, a full refund will be issued.

    6. Shipping

      • Once the pre-ordered item arrives and is processed, standard shipping timelines will apply.

      • You will receive a shipping confirmation with tracking once your order has been dispatched.

    7. Product Changes

      • Product images and descriptions provided at the time of pre-order are based on manufacturer previews and are subject to change prior to release.

    8. Force Majeure

      • We are not liable for any delays or failures in fulfillment caused by events beyond our control, including but not limited to natural disasters, strikes, transport disruptions, or manufacturing issues.

 

5. Manufacturer Damage & Defects

If your item arrives damaged or defective due to a manufacturer issue, we offer a 3-day window from the date of delivery to report the issue. You will have to submit clear photos and a video.

5.1 Reporting & Return Process

  • Customers must contact us within 3 days of receiving the item to request a replacement.
  • Items must be returned in their original, unused condition with all packaging.
  • Customers are responsible for return shipping, insurance, and packaging costs. We do not cover these expenses.

5.2 Replacements & Refunds

  • Once we receive and inspect the returned item, we will ship a replacement within 3 business days, subject to availability.
  • If the item is out of stock, a refund will be issued excluding the original shipping cost.
  • 5 Towns Models & Collectibles is not responsible for lost return shipments. Customers should use a tracked and insured shipping method.

6. Loss & Claim Policy

If your package is lost or damaged while in transit, we will assist in filing a claim with the shipping carrier.

  • Refunds for lost or damaged parcels will only be issued based on the amount successfully recovered from the carrier.
  • 5 Towns Models & Collectibles is not liable for additional compensation beyond what the courier reimburses.
  • All claims must be reported within 1 week from the shipment date.

7. Pre-Orders

  • Pre-orders require full payment at the time of purchase.
  • Estimated delivery dates are subject to change due to manufacturing and shipping delays.
  • Pre-orders are non-cancelable and non-refundable once placed.

8. Warranty & Liability

  • We do not provide warranties beyond what the manufacturer offers.
  • 5 Towns Models & Collectibles is not liable for any indirect, incidental, or consequential damages resulting from the use of our products.

9. Intellectual Property

  • All images, descriptions, and content on our website are the property of 5 Towns Models & Collectibles.
  • Unauthorized use, reproduction, or distribution of our content is strictly prohibited.

10. Privacy Policy

11. Governing Law

These Terms & Conditions are governed by the laws of New York/ Nassau County.

12. Changes to Terms
